1. Consent
1.1 By using this website you agree to these terms and conditions
1.2 All images, text, names, domain names, trademarks and service marks on this site are subject to copyright and/or intellectual property.
1.3 Nothing on this website, or part thereof, may be copied, used, redistributed or reproduced in any way whatsoever without prior written consent of the site owner.
1.4 These terms and conditions are subject to change without notice.
2. Customer satisfaction
2.1 PRICING: The prices quoted on this site are for normal restoration work, which covers most eventualities. However, sometimes a severely damaged image will require extra time. In this situation we reserve the right to levy additional charges, which will be quoted in advance of commencing the work.
2.2 For optimum results, an image should be at least 600dpi or 6 megapixels. Please refer to our “how to prepare your image” page.
2.3 We can work on lower resolution images. However, we will not be liable for an inferior result due to a low-resolution original.
2.4 While we can guarantee the best result possible, given the quality and resolution of the original scan, restoration to 100% is not always achievable from every image.
2.5 On issuing the initial proof, we are happy to make any revisions requested, within a reasonable level achievable for that image.
2.6 In the unlikely event that your final restoration not be to your satisfaction, we will consult with you to address any issues.
2.7 In the rare circumstance that a customer’s concerns cannot be resolved, we reserve the right to reject any further work. In these circumstances there will be no charge and both parties will be free of further liability.
3. Payment
3.1 John’s Photo Restoration charges in Australian dollars. We use STRIPE which is a leading online payment platform that enables secure payment in any of over 100 international currencies.
3.2 While we can accept payment in a range of currencies, the stated price in Australian dollars (AUD $) is the definitive price.
3.3 A 14-day invoice is issued with the initial proof. During this period, customers can request any changes they would like, which we will treat as a priority.
3.4 Invoices contain a convenient payment link. Customers undertake that they will pay their invoice by the due date.
3.5 On completion of the work and receipt of full payment, we will send the final high-resolution image to the customer by email.
4. Copyright
4.1 We are unable to work with images that are subject to copyright or infringe intellectual property or copyright law.
4.2 Customers are advised that copyright on images taken by a professional photographer is owned by the photographer, not their customer. Images that have been previously manipulated may also be subject to intellectual property rights.
4.3 In sending an image to us, the customer accepts that it is their sole responsibility to ensure that it is free of incumbencies. The customer warrants and affirms that the image is not subject to copyright and that no copyright or the rights of any third party will be infringed.
4.4 The customer agrees to absolve Johns Photo Restoration and their officers from any action relating to copyright on images the customer has supplied. Johns Photo Restoration and their officers will not be liable to the customer or any third party for such copyright infringement whatever the circumstances. The customer agrees that they will be solely liable for any copyright or intellectual property claim that may arise.
4.5 Our restoration work on any image we have worked on remains the intellectual property of Johns Photo Restoration. Any publishing of such image must include the tag: “Image restored by https://Johnsphotorestoration.com”
5. Privacy
5.1 We take the privacy of our customers very seriously and will never do anything to knowingly compromise the trust placed in us.
5.2 Customer details held by us are never shared with any third party.
5.3 Finished restored images are forwarded to clients by email and not shared with any third party.
5.4 Customer details and images are retained for a minimum of three years.
5.5 Johns Photo Restoration may, from time to time, publish customer images we have restored to market our services. This may include our website, social media or printed material. In doing so, only images will be used. No customer information, including geographical location, is disclosed.
5.6 Customers are deemed to have consented to clause 5.5 unless we receive written notification to the contrary.
6. Site Security
6.1 For security reasons, images that can be uploaded are limited to jpg, jpeg, png and gif. If you have requirements outside these limitations, please contact us through our contact page.
6.2 While every endeavour is made to keep the Website free from viruses, Johns Photo Restoration does not make any guarantee or representations that the Website is secure or free from viruses.
6.3 Persons using this site must take the necessary steps to ensure appropriate security measures are installed on their device or computer and utilise a virus scanner before downloading any information, software or documentation from the Website.
6.4 Johns Photo Restoration will not be responsible for the transmission of malicious software to or from this site.
6.5 Persons using this site must not misuse our Website by knowingly introducing viruses, trojans, worms, malware or other material which is malicious or technologically harmful.
7. Limitation of Liablity
7.1 In no event shall Johns Photo Restoration nor it’s owners or officers, be liable for anything arising out of or in any way connected with your use of this Website. Nor shall John’s Photo Restoration be held liable for any indirect or consequential liability arising out of or in any way related to your use of this Website.
8. Jurisdiction
8.1 The courts of the state of Western Australia shall have exclusive jurisdiction to adjudicate any dispute arising under or in connection with these Terms & Conditions.
